Despite its historical heritage, Civil Law has proven to be a constantly changing reality, thanks to the evolution of social paradigms, doctrinal development, and jurisprudential impulse.
The General Theory of Civil Law could not remain oblivious to these phenomena.
The purpose of this work is thus to revisit ancestral institutes - such as personality rights, private autonomy, civil responsibility, good faith, and legal personality -, but viewed and examined by present-day experiences and knowledge. Legal situations are also the object of analysis, with special attention given, in addition to the notion of subjective right, to the issues raised by abuse of rights, conflict of rights, and contention of rights.
